AN ORDINANCE AMENDING ARTICLE II OF CHAPTER 9
OF THE CODE OF ORDINANCES OF THE CITY OF
ROCK ISLAND, ILLINOIS
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ROCK ISLAND, ILLINOIS:
Section One. That the following language in strikeout font be eliminated and the new language
shown in italics be added to the following sections of
Article II of Chapter 9:
Sec. 9-26. Penalty:
Unless otherwise provided in this
chapter, any person who violates any of the parking ordinances of the city,
other than a parking meter violation, a private parking ordinance violation, a
zoned parking ordinance violation, or a violation of downtown restricted
parking use ordinance, and who receives a ticket therefore, shall pay a fine of
ten dollars ($10.00) seven dollars
($7.00). In the event the fine is not paid within seven (7) days of the
date of the notice, the operator of the vehicle shall pay as a penalty for and
in full satisfaction of such violation the sum of twenty
dollars ($20.00) seventeen dollars ($17.00). Any person
violating the private parking ordinance in the city shall pay a fine of twenty five dollars ($25.00) twenty dollars
($20.00). In the event the fine is not paid within seven (7) days of the
date of the notice, the operator of the vehicle shall pay as the penalty for
and in full satisfaction of such violation the sum of thirty
five dollars ($35.00) thirty dollars ($30.00). Any person
who receives a notice of a parking meter violation shall pay a fine of seven dollars ($7.00) three dollars ($3.00).
In the event the fine is not paid within seven (7) days of the date of the
notice, the operator of the vehicle shall pay as the penalty for and in full
satisfaction of such violation the sum of seventeen
dollars ($17.00) thirteen dollars ($13.00). Any person who
violates any of the parking ordinances of the city at a location where tow away
placards have been posted on parking control signs shall pay a fine of twenty
five dollars ($25.00). In the event the fine is not paid within seven (7) days
of the notice, the operator of the vehicle shall pay as penalty for and in full
satisfaction of said violation the sum of thirty dollars ($30.00). This section
shall not apply to provisions in this article with different penalties from the
above.
Sec. 9-37. Loading Zones:
( (c) Any person violating any of
the provisions of this section shall be fined fifteen
dollars ($15.00) ten dollars ($10.00). In the event the
fine is not paid within seven (7) days of the date of the notice, the operator
of the vehicle shall pay as the penalty for and in full satisfaction of such
violation the sum of twenty five dollars ($25.00) twenty
dollars ($20.00).
Sec. 9-40. Fire Lanes:
It shall be unlawful for any person
to park any vehicle on that portion of any street designated as a fire lane by
special ordinance in the city. Any agent or employee of the city designated to
enforce the parking ordinances of the city is hereby authorized to cause any
motor vehicle parked in a fire lane in this city to be towed from the fire
lane. In such a case, the owner of the vehicle shall be assessed the cost of
towing and any storage charges in relation thereto plus a fine of twenty five dollars ($25.00) twenty dollars
($20.00). In the event the fine is not paid within seven (7) days of the
date of the notice, the operator of the vehicle shall pay the penalty for and
in full satisfaction of such violation the sum of thirty
five dollars ($35.00) thirty dollars ($30.00).
Sec. 9-41. Snow Removal:
(e) Any agent or employee of the
city designated to enforce the parking ordinances of the city is hereby
authorized to cause any motor vehicle parked in violation of this section to be
towed from any snow route. In such a case the owner of the vehicle may be
assessed the cost of towing and any storage charges in relation thereto plus a
fine of twenty five dollars ($25.00) fifteen dollars ($15.00).
In the event the fine is not paid within seven (7) days of the date of the
notice, the operator of the vehicle shall pay as the penalty for and in full
satisfaction of such violation the sum of thirty five
($35.00) twenty five dollars ($25.00).
Sec. 9-42. Parking On Private
Property:
(a) No person, firm or corporation
shall park a motor vehicle on private property controlled by a private parking
ordinance passed by the city council without the consent of the property owner.
The owner of said property shall pay an annual fee of one hundred dollars
($100.00) to the city of Rock Island and shall post a sign or signs on said
premises indicating that:
(1) Parking is prohibited without the
consent of the property owner;
(2) Parking a motor vehicle without
the consent of the property owner is a violation of city ordinance;
(3) The owner of any vehicle
violating the provisions of this section shall be subject to a fine of twenty five dollars ($25.00) twenty dollars
($20.00); and
(4) Any vehicle violating the
provisions of this section may be impounded and the owner of the vehicle shall
be responsible for all costs of the towing and impoundment.
The size, design, number and location
of these signs shall be approved by the Rock Island public works department.
(b) The owner of any vehicle
violating the provisions of this section shall be subject to a fine of twenty five dollars ($25.00) twenty dollars
($20.00). In the event that the fine is not paid within seven (7) days of
the date of the notice, the owner of the vehicle shall pay as the penalty for
and in full satisfaction of such violation the sum of thirty
five dollars ($35.00) thirty dollars ($30.00).
Any vehicle violating the provisions
of this section may be impounded as described in section 9-30 this division.
Sec. 9-45. Impoundment For Unpaid
Violations:
(g) The fine
fee for impoundment by immobilization shall be one hundred dollars ($100.00) thirty five
dollars ($35.00) and the fine fee
for impoundment by towing shall be one hundred dollars
($100.00) forty dollars ($40.00), plus a storage fee of five
dollars ($5.00) per day.
Sec. 9-88. Overtime Parking, Penalties:
The city council shall hereby adopt
the following progressive fine structure for overtime parking violations:
(1) Upon detection of the first
parking overtime violation, the operator of the vehicle in violation shall be
issued notice of the violation and shall pay a fine of seven
dollars ($7.00) five dollars ($5.00). In the event the fine
is not paid within seven (7) days of the date of the notice, the operator of
the vehicle shall pay as the penalty for and in full satisfaction of such
violation the sum of seventeen dollars ($17.00) fifteen
dollars ($15.00).
(4) In no case shall the operator of
any vehicle in violation of the overtime provision of this division be issued
more than four (4) tickets in any one working day. The maximum fine to be assessed
for parking overtime in a specific parking space in any one working day shall
be thirty seven dollars ($37.00) thirty
five dollars ($35.00). In the event that all such fines are not paid within
seven (7) days of the issuance of notices, the operator of the vehicle shall
pay as the penalty for and in full satisfaction of such violations a sum not to
exceed seventy seven dollars ($77.00) seventy
five dollars ($75.00).
(5) The first overtime parking
violation for a vehicle in any six (6) month period may be forgiven and the
operator of the vehicle may be issued a warning ticket without a fine in lieu
of the five dollar ($5.00) fine described in subsection (1) of this section.
Sec. 9-89. Moving Of Vehicles
Prohibited:
It shall be unlawful for any person
to move any vehicle from any designated zone parking space to any other such
space for the purpose of extending the legal parking limit beyond the posted
time limit. Upon observance of or detection of such offense in accordance with
section 9-37 of this division, the operator of the vehicle shall be issued a
notice of violation and shall pay a fine of twenty five
dollars ($25.00) fifteen dollars ($15.00). In the event the
fine is not paid within seven (7) days of the date of notice, the operator
shall pay as the penalty for and in full satisfaction of such violation the sum
of thirty five dollars ($35.00) twenty
five dollars ($25.00).
Sec. 9-91. Designation of City
Parking Facilities Lots:
The city council shall establish the
following locations as parking facilities lots:
1) Lot A (Levee
Parking Lot), located
between 17th and 18th Streets, 1st Avenue and the Mississippi River.
(2)
Fifth Avenue parking lot (which shall also be known as the Argus parking lot),
located at the northeast corner of 5th Avenue and 18th Street).
(2) Lot B
(Bank Parking Lot), located at the southwest corner of the intersection of 18th
Street with 1st Avenue
(3) Lot C First
Avenue parking lot (which shall also be known as the Spencer Towers
Parking Lot), located at the southwest corner of the intersection of 1st Avenue and 20th Street
and the northeast corner of 2nd Avenue and 19th Street.
(4) Municipal parking building (Ramp), located between 16th and 17th Streets,
3rd and 4th Avenues.
(5) Lot D, Third
Avenue parking lot located at the northeast corner of the intersection of
20th Street with 3rd Avenue.
(6) Lot E
(Ameritech Parking Lot), located at the northwest corner of the intersection of
18th Street with 7th Avenue First Avenue
parking lot (which shall also be known as the bank parking lot) between 17th
and 18th Streets.
(7) Lot F,
located at the northeast corner of the intersection of 18th Street
with the Great River Plaza.
(8) Lot G,
located along the alley connecting 17th and 18th Streets
south of 1st Avenue
Sec. 9-92. Permit System Established:
The city council shall hereby
establish a color coded parking permit system by which specific color permits
authorize parking in specific designated locations. All vehicles parking in a
permit lot or other permit location are hereby required to display an
appropriate color coded permit which shall be contained in a clear vinyl case
and affixed to the lower left corner of the rear windshield of the vehicle.
This permit shall be obtained from the finance department upon payment of the
appropriate fee. The permit system shall be established as follows:
(1) General (green)
parking permits authorize the permit holder to park in the 5th
Avenue parking lot, the 3rd Avenue lot, any uncovered space in the municipal
parking ramp, or designated on street parking locations.
(2) Ramp covered
parking permits authorize the permit holder to park in a covered space in the reserved area within the
municipal parking building.
(3) Rover parking permits authorize
the permit holder to park in any downtown parking location for any length of
time with the following exceptions:
a. Rover permit holders may not park
in any space designated for handicapped parking unless displaying the proper
identifying tags or license plates.
b. Rover permit holders may not park
in any marked loading zone, no parking zone, bus lane or other restricted
parking area.
c. Rover permit holders may not park
at any metered space unless the proper coins are deposited and time limitations
adhered to.
d. Rover permit holders may not
park in the bank lot, the Spencer towers lot, or the levy lot unless the daily
parking fee is paid at one of the cashier gates.
e. Rover permit holders may not park in a space controlled by an
honor box unless the proper payment is deposited in the honor box.

Rover permit holders may not park in an executive parking space in the ramp.

Rover permit holders may not park for more than the posted time limit in any
unmetered space with a time limit of sixty (60) minutes or less.
(4) Executive parking permits
authorize the permit holder to park in a specific assigned space within the
municipal parking building. Such spaces shall be reserved by number, and that
number shall be clearly written on the face of the permit.
(5) General visitor permits authorize
the holder to park in the 5th Avenue parking lot, the 3rd Avenue parking
lot, uncovered spaces in the municipal parking building and designated on
street parking locations and ramp visitor permits allow the holder to park in
any unreserved space in the municipal parking building. All visitor permits
shall be valid for one day only. Visitor permits shall be displayed on the
front left side of the vehicle's dashboard.
(6) 1st Avenue (Lot
C Spencer towers lot) parking permits authorize the permit
holder to park in Lot C. the Spencer
towers lot, the 3rd Avenue lot, the 5th Avenue lot, any uncovered space in the
municipal parking ramp or designated on street parking locations.
(7) Night shift permit holders
shall have the same parking privileges as a general parking permit holder.
(7) Lot D
parking permits authorize the permit holder to park in Lot D.
(8) Ramp
Uncovered permits authorize the permit holder to park in any unreserved,
uncovered space in the municipal parking building.
Sec.
9-93. Fees-Generally:
The city council does hereby
establish the following fee schedule for parking in the municipal parking
facilities.
(1) Municipal Parking Ramp
: Twenty five cents ($0.25) per hour parking without parking permit between the
hours of nine o'clock (9:00) A.M. and five o'clock (5:00) P.M., Monday through
Friday of each week. Violators will be subject to the overtime parking
penalties described in section 9-88 of this article.
(2) The maximum monthly permit
parking rates shall be as follows
a. Executive Parking $55.00
b. Covered parking spaces $27.50
(3) Rover permit $50.00
(4) Visitor permits

Sec. 9-94. Fees-Discounted;
Parking Incentive Plan:
The city council shall hereby
establish a parking incentive plan whereby businesses shall be encouraged to
purchase permit parking for, or on behalf of, their employees who require
parking at the following discounted rate:
General permit, per month $15.00
Ramp permits, covered spaces, per
month $25.00
1st Avenue (Spencer
towers) lot permit, per month $30.00
7th Avenue and 18th
Street lot permit per month $30.00
No discounts shall apply to either
the rover permit or the visitor permit. All purchases made under this section
shall be handled by one authorized business or building representative who
shall establish an account with the city finance department and who shall have
primary responsibility for distributing permits to their employees.
Sec. 9-96. Penalties:
(b) Any person who parks in any of
the city parking facilities lots
beyond the posted time limits shall be subject to issuance of a notice of
violation. The fine for such violation shall be ten
dollars ($10.00) five dollars ($5.00). In the event such
fine is not paid within seven (7) days of the date of notice, the operator of
the vehicle shall pay as the penalty for and in full satisfaction of such
violation the sum of twenty dollars ($20.00) fifteen
dollars ($15.00).
Section Two. All ordinances and parts of
ordinances that are in conflict herewith are hereby repealed, insofar as they
do so conflict.
Section Three. This ordinance shall be in full force and effect from and after
its passage.
